Legislative and Structural Changes

• The Victorian Energy Efficiency Target Amendment (Energy Upgrades for the Future) Act 2025 took full effect from 1 July 2025.
• That Act strengthened compliance and enforcement power for the Essential Services Commission.
• From 1 July, the Act introduces new prohibitions on providing misleading information to the commission.
• Industry participants now face requirements for training, competency and evidence of compliance.
• The amendments also clarify “additionality” rules. That means upgrades already required by other laws could remain eligible under VEU in some cases.
• In tandem, the program’s surrender rules for energy retailers were relaxed. Energy retailers may now surrender certificates created and lodged up to the annual deadline. These changes began on 21 May 2025 for 2024 liabilities.

Updates to Project-Based Activities (PBAs)

• On 26 August 2025, amended PBA Regulations came into effect. Energy

Clarifications in activity eligibility

• The update also addressed ambiguous cases where decommissioning occurred for safety reasons (i.e. a heater was disconnected before program eligibility).

Submission freeze for Activity 44

• Starting 11 July 2025, the VEU Registry applied a submission freeze for Activity 44 (commercial/industrial heat pump water heaters).
• This freeze lasted up to two months while registry updates were performed.

Setting of new targets & regulatory schedule

• Under the VEET Act, future certificate surrender targets must be set in regulation no later than 31 May 2025.
• In 2025, that requirement was met via the new regulatory instruments tied to the 2025 Amendment Act.

Enhanced compliance, penalties, and consumer protections

• Some of the compliance and civil penalty changes began earlier in May 2025. 
• These include stronger ESC powers to issue prohibition and improvement notices.
